Real Estate Law/Rule/Policy Update
A major change that really became unnoticed during the
staggering period that we have been experiencing for the
last couple of years, is that whenever a new license is
issued, that license will expire on its anniversary date
two years following issue. That is important, because many
seasoned licensees still have a fixation on renewing their
licenses November 1 of even number years. Every license
now has its very own expiration date.
Contract Issues - Contract Law
A contract is a voluntary agreement or promise between
legally competent parties to perform some legal act
supported by legal consideration. In real estate
contracts must be in writing to be enforceable in court
with the one exception of a lease for one year or less.
Understanding contracts is more than know how to fill in
the blanks.
Agency as a Contract
According to NAR's 2007 Legal Scan, agency issues remain a
perennial worry for real estate brokers, especially in
areas of breach of fiduciary duties, dual agency, agency
disclosure and issues created by minimum service
agreements.
In this lesson we will continue are coverage of contracts
and discuss agency relationships that we use in our
day-to-day business.
Duties of Principal Brokers to
Supervise
Frequently when considering disciplinary action against
licensees, the Tennessee Real Estate Commission has ask
the question, “Where was the broker” and raised the issue
of whether Principal Brokers are meeting their duty to
adequately supervise the licensees in their firms.
