Real Estate Law/Rule/Policy Update
A major change that really became unnoticed during the
staggering period that we have been experiencing for the
last couple of years, is that whenever a new license is
issued, that license will expire on its anniversary date
two years following issue. That is important, because many
seasoned licensees still have a fixation on renewing their
licenses November 1 of even number years. Every license
now has its very own expiration date.
Disclosures
This section focuses on property disclosure issues.
Property condition disclosure is determined almost
exclusively by state law. Therefore, licensees are
encouraged to become familiar with Tennessee state laws
governing property disclosure, stigmatized property,
Megan's Law, and disclosure of latent defects. It is hoped
this section will help to educate the real estate
professional on these important topics, and will serve as
a guide to reducing risk.
Contract Issues
A contract is a voluntary agreement or promise between
legally competent parties to perform some legal act
supported by legal consideration. In real estate
contracts must be in writing to be enforceable in court
with the one exception of a lease for one year or less.
Understanding contracts is more than know how to fill in
the blanks.
Duties of Principal Brokers to
Supervise
Frequently when considering disciplinary action against
licensees, the Tennessee Real Estate Commission has ask
the question, “Where was the broker” and raised the issue
of whether Principal Brokers are meeting their duty to
adequately supervise the licensees in their firms.
Ethics
Both the Tennessee Real Estate Commission and The
REALTORS®' Code of Ethics and Standards of Practice are
complaint driven. The Tennessee Real Estate Commission
does have the power upon its own motion to take action,
but generally act only on a verified complaint. Therefore,
if nobody signs a complaint, nobody gets punished. It is
as simple as that: No action, no reaction, and no
punishment for that wrong doer that cause you grief or
acted unethical.
So, how do you call the Real Estate Police? The answer is,
you don't! Why? Because you are the real estate police.
This section will discuss your moral and legal obligations
to the State of Tennessee, and the Association of
Realtors® if you are a member.

This section provides an in-depth analysis of
discriminatory housing practices. Topics covered include:
The Fair Housing Act, The 1988 Fair Housing Amendments
Act, Fair Housing Advertising, Fair Housing Enforcement,
The Voluntary Affirmative Marketing Agreement, and Fair
Housing Case Law.
