PROPERTY DISCLOSURES

Today's real estate professional works in a highly litigious environment. Lawsuits against licensees continue to escalate at an alarming rate.  Approximately two-thirds of all lawsuits brought against real estate professionals are based on misrepresentation, negligence, or fraud. Knowing what, when, and how to disclose is of utmost importance.

This course focuses on the key property disclosure issues. Property condition disclosure is determined almost exclusively by state law. Therefore, licensees are encouraged to become familiar with their state laws governing property disclosure, stigmatized property, Megan's Law, and disclosure of latent defects.

It is hoped this course will help to educate the real estate professional on these important topics, and will serve as a guide to reducing risk.

Features:

Case Law–Analysis of more than 20 recent cases, covering all areas of property disclosure
Theories of Legal Liability–Misrepresentation, active and passive fraud, negligent misrepresentation, negligent nondisclosure, and negligent advice
Key Liability Topic Areas–Mold, lead-based paint, stigmatized property, and other environmental concerns
Sample mold disclosure forms and necessary lead-based paint disclosure forms
